Signed into law in 2025, the TAKE IT DOWN Act (Targeting Abusive and Non-Consensual Intimate Digital Depictions) is a federal statute requiring online platforms to remove non-consensual intimate imagery (NCII) within 48 hours of a valid notice. For the first time, knowingly publishing NCII is a federal crime, not just a civil matter subject to state revenge porn laws. The law provides a federal cause of action with serious criminal penalties.
The TAKE IT DOWN Act covers both real photographs and videos and AI-generated content. If someone creates a realistic synthetic intimate image of you without your consent, commonly called a deepfake, and posts it online, the 48-hour removal requirement applies. This was a significant expansion beyond prior law, which often did not clearly address AI-generated intimate imagery of real people.
To request removal under the TAKE IT DOWN Act, submit a notice to the platform identifying the content and affirming that it depicts you without your consent. Platforms must establish intake processes for these notices. StopNCII.org offers a complementary hash-based protection system allowing platforms to detect and block your images proactively, without requiring you to find and report each instance individually. If a platform fails to act within 48 hours of a valid notice, they may face liability under the statute.
